Gerald Maatman Published in Business Insurance "Few Victories for Employers in Latest Court Term"

Gerald Maatman’s article, "Few Victories for Employers in Latest Court Term," was published in the August 18, 2008 issue of Business Insurance. In his article, Jerry discusses how only two of the ten Supreme Court employment cases of the 2007/2008 term were employer-friendly. Although the Supreme Court assumed a pro-business stance on many legal issues, employment law was not one of those areas.
Jerry explains, "the mosaic created by the other rulings expanded remedies for plaintiffs, construed workplace laws expansively for employees, preempted state remedies in favor of federal regulation and clarified burdens of proof applicable to corporations sued by workers." The other eight rulings, according to Jerry, "tilt the workplace litigation playing field decidedly in favor of plaintiffs. Four decisions open the courthouse doors to plaintiffs asserting workplace bias and benefits claims under federal laws, or make assertion of such claims easier to prove."
