Gerald Maatman’s article, “The Newly Emboldened EEOC What Its Enforcement Philosophy Means for Staffing Companies,” published in the May/June 2008 issue of Staffing Success Magazine examines the strategic enforcement and litigation plan of the U.S. Equal Employment Opportunity Commission and alerts staffing companies on what to do.

Jerry notes, “The EEOC often investigates small and midsize employers on the theory that their compliance programs are less sophisticated than industry leaders or that a lack of human resource department translates into more discrimination problems.”  The EEOC has made an agencywide priority to prosecute lawsuits that involve alleged patterns or practices of discrimination. Jerry suggests, “…[E]very staffing firm should redouble its efforts to ensure that it has policies and procedures in place to ensure that individuals applying for temporary work are hired and assigned in a nondiscriminatory manner. This includes procedures to ensure that discriminatory client requests are not honored and that immediate corrective action is taken if a staffing firm learns that one of its employees has been discriminated against.”
